These Terms of Service ("Terms") govern your access to and use of this website, the Checkered Club membership program, and all related Experience Circuit events, experiences, benefits, products, content, features, and services (collectively, the "Services") operated by Illuminate Experience Group LLC (dba Experience Circuit) ("Illuminate," "we," "us," or "our"). By accessing or using the Website, purchasing a Checkered Club membership, registering for an event, or participating in any Experience Circuit event or experience, you agree to these Terms. If you do not agree to these Terms, please do not use the Website or purchase or participate in the Services. 

CHECKERED CLUB MEMBERSHIPS 

The Experience Circuit’s Checkered Club offers multiple membership levels designed to provide members with different levels of access, benefits, experiences, and engagement throughout the applicable Motorsports season. Membership levels may include: Insider, Checkered Club, Checkered Club Premium, Winners Circle Standard, Winners Circle Premium, and Winners Circle Crown Jewel, as described on the Website at the time of purchase or enrollment. The specific benefits associated with each membership level are subject to availability, event capacity, venue requirements, scheduling, and other applicable event conditions. 

Insider Membership – FREE 

Insider is the entry-level Experience Circuit community membership. Benefits may include: 

Insider membership does not require a membership fee but may require registration and acceptance of applicable terms. 

Checkered Club Membership – $100 

Checkered Club is a paid Experience Circuit membership that provides enhanced member benefits. Benefits may include: 

Checkered Club Premium Membership – $250 

Checkered Club Premium provides an elevated level of Experience Circuit membership. Benefits may include: 

Winners Circle Membership 

Winners Circle is an annual, season-long Experience Circuit membership program. A Winners Circle membership is not a race-by-race purchase and is not a package based on a predetermined number of races. Members purchase one annual membership tier: 

Provides Standard-level access, benefits, and experiences throughout the applicable membership season. 

Provides Premium-level access, enhanced benefits, and experiences throughout the applicable membership season. 

Provides the highest level of access, benefits, and experiences available through the Winners Circle program throughout the applicable membership season. 

Depending on the applicable tier and event, Winners Circle benefits may include: 

Specific benefits may vary by membership tier and race weekend. 

No Fixed Number of Races Included 

Membership fees are not based on a fixed number of race weekends. In particular, Winners Circle Standard does not represent six races, Winners Circle Premium does not represent nine races, and Winners Circle Crown Jewel does not represent four races. 

Instead, a Winners Circle membership provides season-long eligibility for experiences and benefits associated with the member's selected tier, subject to availability and the applicable event requirements. 

The Experience Circuit season may include approximately 18 race weekends. The race calendar may change, and individual experiences may be modified, postponed, canceled, substituted, or become unavailable. Purchasing a membership does not guarantee admission to every race, event, hospitality experience, venue, activity, or other program element. 

Membership Benefit Changes 

Benefits described on the Website are intended to communicate the general nature of each membership level. Illuminate may modify, substitute, add, or remove specific benefits when reasonably necessary due to event logistics, venue restrictions, capacity, availability, safety, scheduling, weather, partner requirements, or circumstances outside of Illuminate's reasonable control. 

Where a specific benefit is subject to registration, capacity, availability, or other requirements, eligibility for that benefit does not guarantee participation unless otherwise expressly confirmed by Illuminate. 

SEASON-LONG MEMBERSHIP STRUCTURE 

The Winners Circle membership program is expected to include approximately 18–19 race weekends during the applicable season. The race calendar is provided as an overview of the season and does not represent a specific number of races purchased or included with membership. 

A member's ability to participate in a particular event or experience may be subject to: 

Membership does not guarantee admission to every individual event, hospitality area, activity, venue, or experience. 

NO FIXED NUMBER OF RACES INCLUDED 

The Winners Circle membership tiers are not defined by a fixed number of races. Specifically: 

Instead, each membership provides season-long eligibility for experiences associated with the member's selected tier, subject to these Terms and the specific requirements communicated for each event. The number, timing, location, format, and availability of events may change during the season. 

MEMBERSHIP BENEFITS 

Depending on the membership tier and individual event, Winners Circle benefits may include:

Not every benefit will necessarily be available at every race weekend. 

Illuminate reserves the right to modify, substitute, add, or remove benefits when reasonably necessary due to event logistics, venue requirements, capacity, availability, safety, scheduling, weather, or circumstances outside of Illuminate's reasonable control. 

MEMBERSHIP PURCHASE 

Memberships may be purchased through the Website using Shopify and/or other applicable third-party payment processors. By completing a membership purchase, you represent that: 

MEMBERSHIP TERM 

Unless otherwise stated at the time of purchase, Winners Circle membership is valid for the applicable Motorsports season identified on the Website or in your purchase confirmation. The membership begins on the applicable membership start date and expires at the end of the applicable membership season. Memberships do not automatically renew unless expressly stated at the time of purchase and accepted by the member. Membership benefits expire at the end of the applicable membership term. 

EVENT REGISTRATION AND AVAILABILITY 

Certain events or experiences may require advance registration, RSVP, ticketing, guest information, or other confirmation. Members are responsible for completing required registration or RSVP processes within the applicable deadlines. Failure to register or RSVP by a stated deadline may result in the member being unable to participate in that particular event or experience. 

Purchasing a Winners Circle membership does not automatically reserve a seat, ticket, hotel room, transportation, hospitality space, or other accommodation for every event. Access to any particular event or experience may be limited based on capacity and availability. 

RACE AND EVENT CHANGES 

Motorsports events are subject to changes, postponements, cancellations, venue restrictions, weather, safety concerns, scheduling changes, governmental requirements, and other circumstances. 

Illuminate reserves the right to: 

When reasonably possible, Illuminate will communicate material changes to affected members. A change, postponement, cancellation, or substitution of an individual race or experience does not automatically entitle a member to a refund of the entire annual membership fee. 

GUESTS 

Any guest access associated with a Winners Circle membership is subject to the specific benefits and rules communicated for the applicable membership tier and event. Guest capacity may vary by event. Members may be required to provide guest names, contact information, or other information before a guest may participate. Members are responsible for ensuring that their guests comply with applicable event rules, venue policies, and these Terms. 

MEMBERSHIP TRANSFERS AND RESALE 

Unless expressly permitted by Illuminate, memberships, credentials, tickets, invitations, benefits, and other access rights may not be: 

Illuminate reserves the right to cancel or invalidate memberships, credentials, tickets, invitations, or benefits that are obtained, resold, transferred, or used in violation of these Terms. 

PAYMENT 

Membership fees are due at the time of purchase unless otherwise stated. All applicable taxes, fees, and other charges will be disclosed during the purchase process where required. Payment processing may be performed by Shopify or another third-party payment processor. By submitting payment information, you authorize the applicable payment processor to process the transaction. 

CANCELLATION AND REFUNDS

Unless otherwise expressly stated in the applicable refund policy: 

Membership purchases are for the annual membership term; 

Non-attendance at an individual race weekend or experience does not constitute cancellation of the membership; 

Failure to RSVP or register for an individual event does not automatically create a right to a refund; 

Changes to an individual race or experience do not automatically create a right to a refund of the full annual membership fee; and 

Any refund, credit, or other remedy will be provided only as expressly stated in the applicable refund policy or as otherwise required by applicable law. 

EVENT CANCELLATION OR SUBSTITUTION 

If an individual event or experience is canceled, postponed, or materially changed, Illuminate may, at its discretion and subject to applicable law: 

The cancellation or modification of one event does not automatically cancel the member's season-long membership. 

MEMBER CONDUCT 

Members and guests must comply with all applicable laws, venue policies, event rules, security procedures, and reasonable instructions from event personnel. Illuminate may suspend or terminate access to the Services, membership, or an event if a member or guest engages in conduct that is: 

Where permitted by applicable law, termination for misconduct may occur without a refund. 

ASSUMPTION OF RISK 

Motorsports events and related activities involve inherent risks. These risks may include, without limitation: 

By participating in a Winners Circle event or experience, you acknowledge these inherent risks and agree to follow all safety instructions, venue requirements, and applicable rules. Certain events or activities may require you to execute a separate waiver, release, assumption-of-risk agreement, or other documentation before participation. 

PHOTOGRAPHY, VIDEO, AND RECORDING 

Photography, video, audio recording, and other media may be captured at Winners Circle events and experiences. By attending or participating in an event, you acknowledge that you may appear in photographs, videos, recordings, or other media. To the extent permitted by applicable law, you grant Illuminate and its authorized partners the right to use your name, image, likeness, voice, and appearance captured in connection with the event for legitimate promotional, marketing, editorial, archival, and commercial purposes without additional compensation. If a particular event includes a separate media release or waiver, that document will govern to the extent of any conflict. 

INTELLECTUAL PROPERTY 

All content available through the Website and Services, including text, graphics, logos, photographs, videos, designs, trademarks, service marks, and other materials, is owned by or licensed to Illuminate or its partners and is protected by applicable intellectual property laws. Except as expressly permitted, you may not reproduce, modify, distribute, display, publish, sell, license, or otherwise exploit such content without prior written permission. 

PROHIBITED USE 

You agree not to: 

THIRD-PARTY SERVICES 

The Services may rely on or provide links to third-party services, including Shopify, payment processors, event platforms, transportation providers, hospitality providers, venues, ticketing providers, marketing platforms, and other service providers. Your use of a third-party service may be subject to that provider's separate terms and privacy policies. Illuminate is not responsible for the availability, performance, content, policies, or practices of third-party services. 

WEBSITE AVAILABILITY 

We do not guarantee that the Website or Services will always be available, uninterrupted, secure, or error-free. Illuminate reserves the right to modify, suspend, or discontinue portions of the Website or Services when reasonably necessary. 

DISCLAIMER 

To the maximum extent permitted by applicable law, the Website and Services are provided on an "as available" and "as is" basis. Illuminate does not guarantee that the Website or Services will meet every user's expectations or that every advertised experience or benefit will be available at every event. 

LIMITATION OF LIABILITY 

To the maximum extent permitted by applicable law, Illuminate Experience Group and its affiliates, officers, directors, employees, contractors, agents, and partners will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to: 

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law. 

INDEMNIFICATION 

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Illuminate Experience Group and its affiliates, officers, directors, employees, contractors, agents, and partners from claims, damages, liabilities, costs, and expenses arising from:

Your use of the Website and Services is also governed by our Privacy Policy, which explains how we collect, use, disclose, and otherwise process personal information. 

CHANGES TO THESE TERMS 

Illuminate may update these Terms from time to time to reflect changes to the Services, membership program, business practices, technology, legal requirements, or other operational considerations. We will post revised Terms on the Website and update the "Last Updated" date. Where required by applicable law, we will provide additional notice of material changes. Your continued use of the Website or Services after revised Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law. 

GOVERNING LAW 

These Terms will be governed by and interpreted in accordance with the laws of the State of Idaho, without regard to conflict-of-law principles, except where applicable law requires otherwise. 

Any dispute arising from or relating to these Terms or the Services will be subject to the applicable courts located in Ada County, Idaho, unless otherwise required by applicable law. 

SEVERABILITY 

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect to the maximum extent permitted by applicable law.
